NBA, union conclude talks with no deal

In what was widely presumed to be the league's last and best proposal in a labor standoff now into its fifth month, NBA commissioner David Stern on Thursday offered his locked-out players a 72-game season that would start Dec. 15.

Yet the league's latest pitch, according to sources briefed on its contents after adjustments were made Thursday night, contained what the union regards as minuscule financial inducements for the players after nearly 24 hours of negotiations this week.

And that clearly disappointed union leaders, who were expecting more after they made a commitment earlier in the week, for the first time since the lockout began, to accept a 50/50 split of annual Basketball Related Income.

NBPA executive director Billy Hunter struggled to mask how underwhelmed he was by the new proposal, even as he was telling reporters that he would present it to the player representatives from all 30 teams as early as Monday as a possible prelude to a full vote from the union's estimated 450 members.

"It's not the greatest proposal in the world," Hunter said. "But I have an obligation to at least present it to our membership. So that's what we're going to do."

If the players take the deal, Stern and deputy commissioner Adam Silver said the league would open the season with a compressed free-agency period and training camp after an estimated 10 days to resolve a slew of what Hunter called ancillary items, then put the new labor accord in writing.

The playoffs and NBA Finals, under that plan, would have to start one week later than usual to accommodate the 72-game regular season.

"We don't expect them to love every aspect of our revised proposal," Stern conceded. "I would say that there are many teams that don't like every aspect of our revised proposal.

"(But) we moved as far as we could and now we're at where we're at."

The ominous response from one source connected to the NBPA, who expects the union to reject the proposal next week after learning of the tweaks offered by the league on the five or so "system" issues that have kept the parties at an impasse: "Nothing was addressed. It's basically the same offer as it was before.

"No way this deal gets taken (by the players). They didn't move on any system issues that concerned us. It's still basically (like) a hard cap with very restrictive rules for player movement."

The most notable elements of the new proposal, confirmed by sources on both sides to ESPN The Magazine's Chris Broussard, are the rise of the "mini mid-level exception" from $2.5 million every other season to $3 million every season and the creation of the additional $2.5 million exception for teams that qualify.

The league, sources said, also relented to some degree on its insistence that taxed teams can't participate in sign-and-trade deals.

Owners are now proposing a phase-in of that restriction that would start in Year 3 of a new labor pact, meaning that prominent summer 2012 free agents such as Dwight Howard, Chris Paul, Deron Williams and Steve Nash still would be eligible to switch teams via sign-and-trade.

The owners, sources say, also have offered to raise minimum team payrolls (which historically had been 75 percent of the salary cap) and raise some season-to-season salary increases. But one source close to the process told Broussard that while these changes may look significant, "the problem with all of that is that the owners changed the definition of a taxpayer in a way that would destroy (Larry) Bird rights and make it almost impossible to be a taxpayer, so the exceptions would be lost anyway."

The league is clearly banking on the premise that a majority of players, angry as some might be, are no longer willing to stomach this labor battle and will ultimately relent if this offer is indeed put up for a vote.

The lockout has lasted for 134 days, but voting for the deal now and playing out a 72-game season likely enables players to return to work with only one missed paycheck, while voting this deal down greatly increases the likelihood the entire 2011-12 season will be canceled.

It is likewise conceivable that a rising decertification movement will be under way at the same time that the union is deciding whether it should ignore the widespread reservations and vote on the league's offer.

Sources close to the decertification movement told ESPN.com that there was a growing desire, as of Thursday night, to start the decertification clock as quickly as possible by filing the requisite petition to the National Labor Relations Board calling for a decertification vote with the signatures of some 200 players.

A firm decertification timetable won't be established before Friday at the earliest, but sources said that Monday is the target date to file the petition, factoring in that Friday is the Veterans Day holiday.

Hunter himself acknowledged in a Tuesday night interview with NBA TV that the fast-moving decertification push -- fronted most notably by Boston Celtics star Paul Pierce -- has "close to" 200 players in the process of signing a petition that would trigger a decertification vote.

The movement, sources said, has grown to include more than the original seven agents (Mark Bartelstein, Bill Duffy, Dan Fegan, Leon Rose, Jeff Schwartz, Arn Tellem and Henry Thomas) who have been advocating decertification for months.

The two-step decertification process requires 30 percent of the league's workforce -- an estimated 130 players -- to sign the petition calling for a vote. That petition is then forwarded to the NLRB, which would take up to 45 days to ratify the petition and arrange the vote, during which the union and league could continue to negotiate.

Decertification backers believe that the fear of the unknown, with the labor fight potentially moving into courtrooms, would finally move NBA owners off the extreme hard-line negotiating stance they've maintained and lead to a more palatable offer during that 45-day window.

Stern, though, insists that the league has no interest in further talks if Thursday's proposal is rejected.

He repeated last week's vow that if rebuffed by the NBPA the owners will "reset" to their far more rigid proposal from earlier in the summer, when they called for a 53/47 revenue split in their favor, along with a restrictive flex salary cap and rollbacks on existing salaries.

"There comes a time when you have to be through negotiating," Stern said, "and we are.

"I am optimistic owners will approve (the deal) if the players approve it and I await their response. We've done our best."

Only a simple majority of teams is needed to approve any labor contract on the league side, but one league source told ESPN.com late Thursday that he expects "more than 20 teams" to sign off on the deal.

That's despite the ongoing battles within the ownership ranks between small-market franchises seeking harsh tax penalties and other restrictions on big spenders to limit player movement, all part of the league's claim that it has to improve its competitive balance after seeing just nine franchises win championships in the past 31 seasons.

"It's been a long haul, man," Hunter said, explaining his weary look at a news conference Thursday night following the second marathon bargaining session in two days, this one spanning some 11 hours. "We're coming near the end of it. We're trying to get this thing done."

Hip Hop/RNB Album Sales: The Week Ending 11/6/2011

Wale and Justin Bieber battle for the #1 spot. Tyrese scores a Top 10 album featuring Jay Rock and Ludacris, while Insane Clown Posse's compilation hits the charts with Ice-T, Big Hutch and MC Breed.

In a career that's been recognized for over six years, DXnext alum Wale is having the time of his life. Only Justin Bieber's holiday album, Under The Mistletoe topped the Washington D.C. area emcee's second album - and by less than 50,000 units. With an impressive debut week, Wale's lone partner in Hip Hop added to the charts was Michigan duo Insane Clown Posse, who delivered a Rap-heavy double disc compilation that scored a Top 150 debut. Wale Nearly Tops The Charts With Ambition

In the last year, Wale left Mark Ronson's Allido/Interscope Records for Rick Ross' Maybach Music Group/Warner Brothers situation. Releasing his second album in as many years, the 2007 HipHopDX Rookie Of The Year was welcomed with a #2 debut, selling just under 164,000 units. Ambition features production from notorious trunk-rattlers DJ Toomp and Lex Luger, with guess appearances from MMG brethren Meek Mill and Rick Ross ("Ambition" ), as well as former verbal sparring buddy Kid Cudi ("Focused" ). MMG's Self-Made group compilation album from earlier this year enjoyed Wale's push, and climbed four spots to #181. I.C.P. Brings Work With Ice-T, MC Breed, Big Hutch Onto The Charts

Veteran R&B singer/actor (and sometimes rapper) Tyrese scored a Top 10 debut. Black Ty's fifth studio album, Open Invitation features rappers Rick Ross, Ludacris, as well as Strange Music/Top Dawg Entertainment's DXnext alum, Jay Rock ("I'm Home" ). The release came on Tyrese's Voltron Recordz boutique label, under EMI distribution.

Insane Clown Posse's Featuring Freshness scored a Top 150 debut. The double-album compilation features Violent J and Shaggy 2 Dope's collaborations within their Psychopathic Records family on the first album, and various artists on the second album. Hip Hop artists ranging from Tech N9ne and Snoop Dogg to Above The Law's Big Hutch and the late MC Breed appear. Presently, Hutch, a former Ruthless and Death Row Records artist, is touring with I.C.P. Featuring Freshness was released on the group's own Psychopathic imprint. Verdict reached in trial of Jackson's doctor

Visit msnbc.com for breaking news, world news, and news about the economy

LOS ANGELES — The jury has reached a verdict in the case against Michael Jackson's doctor. The verdict will be read at about 4 p.m. ET to allow families and other parties time to return to the courthouse.

The seven-man, five-woman panel had to be unanimous on their decision to either convict or acquit Dr. Conrad Murray of involuntary manslaughter in Jackson's June 2009 death. They began deliberating Friday and did not meet over the weekend. Overall they deliberated for about nine hours. Video: Watch KNBC's live coverage leading up to verdict (on this page)

After hearing the news, Jackson's sister La Toya tweeted "Verdict is FINALLY IN!!! I'm on my way! I'm shaking uncontrollably!"

Jackson died from a fatal dose of the anesthetic propofol; Murray has acknowledged giving Jackson propofol to help him sleep. Slideshow: See fans gathering at courthouse (on this page)

During closing arguments of the six-week trial, attorneys for the Houston-based cardiologist attacked prosecutors and their witnesses, saying they had over time developed stories and theories that placed the blame for Jackson's death squarely on Murray.

Prosecutors countered that Murray was an opportunistic and inept doctor who left Jackson's three children without a father. They said that Murray giving Jackson propofol as a sleep aid violated standards of care and amounted to a secret experiment in which the doctor kept no records. Story: Tito Jackson: Security kept family from Michael

Jurors heard from 49 witnesses and have more than 300 pieces of evidence to consider. They were given lengthy instructions by the judge about how to deliberate.

If Murray is convicted, he faces a sentence ranging from probation to four years behind bars, and he would lose his medical license. The sentence will be decided by Superior Court Judge Michael Pastor after receiving input from attorneys for both sides and probation officials, if necessary. Video: Did Murray kill Jackson or did Jackson kill himself? (on this page)

A recent change in California law means that Murray, 58, might serve any possible incarceration in a county jail rather than a state prison. A prison term could be shortened by overcrowding.

If acquitted, Murray could still be pursued by medical licensing authorities in the states of California, Nevada and Texas.

Decision will be announced at 4 p.m. ET to allow families, other parties time to reach court

WATCH THE THRONE RECAP (JERSEY EDITION)

EAST RUTHERFORD, New Jersey -- How many rappers you know can take it this far? On Saturday, the Throne (b.k.a. as Jay-Z and Kanye West) touched down in Dirty Jersey, kicking off a tri-state-area lap of sorts on the way to what some have billed as the main event on the titans' tour: Madison Square Garden. But that's not to say the rap duo balled any less hard at the IZOD Center, the first of a two-night stand that picks up again tonight.

MTV News brought you the first look at Jay and 'Ye's massive stage show as well as the set list when the Watch the Throne Tour had liftoff in ATL, and the set didn't disappoint. The MCs open up on opposing cubic platforms that are not coincidentally throne-like; as menacing images of barking rottweilers and Great Whites flash across the elevated risers, you find yourself looking for the symbolism in everything.

While KanyeToTha and Young (ever notice great MCs always have more aliases than you can count on five fingers?) were bouncing back and forth between their back-catalogs -- an embarrasing pile of classic material that included rap-along faves like "Where I'm From," "Can't Tell Me Nothing," "Big Pimpin,' " "Flashing Lights" and "Dirt Off Your Shoulder" -- we were marveling at how this once-crooked son of Brooklyn's Marcy Projects and a college dropout from the Chi wound up selling out arenas. And that's when it occurred to us that these men, rapping to a backdrop that shifted from jungle scenes straight outta Nat Geo to iconic images of Malcolm and MLK, are simply the embodiment of the American Dream.

And it's a point the pair clearly wanted to drive home. As the bittersweet Frank Ocean-serviced hook from "Made In America" played overhead, Hov (in his signature Yankee snapback, American flag handkerchief poking from his back pocket) and Yeezy (in Givenchy jacket and that leather kilt) turned their backs to the crowd to watch projections of savage Civil Rights-era turmoil.

"We're living our dream tonight," Jay said with 'Ye at his side. The stage lights had faded to black with the arena illuminated by a sea of BIC lighters and iPhones. "That light represents your dream, know that they can come true," he continued. The man who went from chopping grams to chopping verses then asked us to salute all those who came before, who poured "blood, sweat and tears" to make it possible for the Roc duo to have arrived at their rarefied perch.

After a rock-tinged rendition of Jay's "99 Problems," the strains of Louis Armstrong's "What a Wonderful World" provided the soundtrack for another politically charged montage -- this one with heartbreaking looks at Katrina-ravaged New Orleans and a handful of man-made disasters. All of that gave way to the spooky 88 Keys production "No Church in the Wild," with OF's resident crooner Ocean doing vocal duties again via a track.

Still, even with all of the thought-provoking moments that push the show along, this run is emphatically about triumph. An exuberant Kanye and Jay recreated the "Otis" clip, complete with the thrones-and-stripes flag suspended behind them. Anyone with a ticket to this jaunt will have a hard time arguing that Jay isn't the greatest living rapper of our time. He'd make subtle adjustments to his snapback, each gesture like clicking an on-switch for Jay to spit another dizzyingly dense pack of verses, sometimes a capella. And 'Ye, who once lobbied the Roc-A-Fella boss for a chain and a spot on the lineup, has more than come up. They say you have to kill your gods to succeed: While West traded onstage glances and grins with Hov that seemed to hint he's still kinda pinching himself about the company he keeps, he knows we've all finally decided to let him be Great.

"If you escaped what I escaped, you'd be in Paris gettin' f---ed up too!" Jay declared on "N---as In Paris." Anyone who's ever walked the stretch of Flushing Avenue that's home to BK's still-striving Marcy has a notion of what the Roc Nation mogul "escaped." "I'm supposed to be locked up too," he admits on the song. Maybe that's why the dynamic duo capped the raucuous two-hour-plus event by repeatedly running through the infectious Hit Boy track, even hilariously dusting off each other's outergarments on the "What's that jacket, Margiela?" line.

Not bad, huh, for some rappers?

Batman Movie in Newark:More Details

Residents travelling to Newark can expect traffic jams downtown next week — especially along Raymond Boulevard — as Warner Bros. shoots scenes for the upcoming Batman movie, "The Dark Knight Rises."

An emailed memo outlining details about the filming said scenes for "Magnus Rex," the film's code name, will be shot at 1100 Raymond Boulevard, a building that houses a Social Security satellite office and other federal agencies. The massive, gray structure is across the street from the Seton Hall Law School.

Image Hosting by PictureTrail.com

This week, city officials declined to comment on whether the latest installment in the Batman series was coming to Brick City. On Wednesday, officials sent an email to news reporters that informed residents of road closures and mass transit delays on Thursday, Nov. 3, and Friday, Nov. 4, between 7 a.m. and 7 p.m. because of "filming," but did not name the movie.

Thursday's memo, though, sent by a federal official to employees in the Raymond Boulevard building and obtained by Patch, outlines some of the movie shoot. In the email, the official wrote that he met with a Warner Bros. representative.

The memo said on Friday, Nov. 4, there will be 100 actors dressed as police officers for a shoot, which will take place at the northwest corner of the building from approximately 1 p.m. to 4 p.m. In addition to the actors, there will be mock SWAT and emergency vehicles, according to the email.

The memo also details preparations for the filming, including lining movie trucks along Mulberry Street on Nov. 3 and cleaning windows of the Raymond Boulevard building on Oct. 31 and Nov. 1.

The email states Warner Bros. crews will be based at Military Park during at least one of the two days of filming.

Rumors of "The Dark Knight Rises" shooting in Newark have swirled since May, when Newark Mayor Cory Booker announced on Twitter that he met with the film's producer.

His tweet read, "Met with the producer and studio team for the next Batman Movie. Great people! They hope to film scenes in Nwk. Holy Brick City Batman! POW!"

Scenes for "The Dark Knight Rises" already have been shot in Los Angeles, Pittsburgh and Jodhpur, India. The film is being directed by Christopher Nolan and stars Christian Bale as the Caped Crusader. It is scheduled to open in theaters next summer.

SHAQ: I WANTED 'TO KILL' KOBE

It's no secret the two superstars clashed in L.A., but things didn't hit rock bottom until Bryant gave a particularly

nasty interview.

Deadspin offers excerpts of Shaq Uncut: My Story, Shaquille O’Neal’s autobiogaraphy written with Jackie MacMullan, which hits on topics such as his rocky relationship with Kobe Bryant and a feud with Pat Riley that led to his departure from the Miami Heat.

Here’s what Shaq has to say about the Lakers before the 2003-04 season, his last in L.A., and also the one that followed Bryant's sexual assault charge in Colorado: “I'm on edge because I don't have a new deal, and Kobe is on edge because he might be going to jail, so we're taking it out on each other. Just before the start of the '03-'04 season the coach staff called us in and said, ‘No more public sparring or you'll get fined.’ ... Phil (Jackson) was tired of it. Karl Malone and Gary Payton were sick of it. ...

“So what happens? Immediately after that Kobe runs right out to Jim Gray and does this interview where he lets me have it. He said I was fat and out of shape. He said I was milking my toe injury for more time off, and the injury wasn't even that serious. (Yeah, right. It only ended my damn career.) He said I was ‘lobbying for a contract extension when we have two Hall of Famers playing pretty much for free.’ I'm sitting there watching this interview and I'm gonna explode. Hours earlier we had just promised our coach we'd stop. It was a truce broken. I let the guys know, ‘I'm going to kill him.’”

... From that day on, I was done dealing with Kobe. I was done dealing with Jim Gray, too.”

O’Neal left the Lakers for the Heat after that season, and he goes on in the book about an intense encounter which Riley.

“My ticket out of Miami was punched in mid-February 2008," Shaq says in the book. "There was a lot of tension between Pat and the players. So we're about to start practice and Jason Williams comes in about ten seconds late. Pat being Pat, he starts swearing at him and screaming, ‘Get the hell out of here!’...

I tell Pat we're a team and we need to stick together, not throw guys out of the gym. Pat is screaming at me and says if I don't like it, then I should get the hell out of practice, too.

"That's when I said, 'Why don't you make me?'"

From there, Shaq writes, he and Riley got into a face-to-face confrontation as several Heat players tried to break them up.

“I finally turn around and tell (Alonzo Mourning), ‘Don't worry, I'm not going to hit the man. Do you think I'm crazy?"

The book hits shelves on Nov. 15 and can also be ordered on Amazon.
